Prior to 2018, Mid-America Apartments (MAA) imposed restrictive screening criteria that excluded many prospective tenants, including anyone with a felony conviction. As a result, Black and Latino renters were between two and twelve times as likely to be prevented from applying compared to white applicants. ERC sued and reached a settlement requiring MAA to conduct individualized assessments of applicants with criminal records. MAA’s new policy also prohibits the consideration of arrests or pending charges, expunged convictions, and convictions reversed on appeal.
