Fair Employment
Title VII of the Civil Rights Act of 1964 prohibits employment discrimination based on race, sex, national origin or religion. It also prohibits an employer from taking retaliatory action against an individual for opposing or complaining about unlawful employment practices.
People with disabilities are protected from employment discrimination under Title I of the American with Disabilities Act of 1990. A person qualified for a job may not be refused employment because of his or her disability. It too protects employees against retaliatory actions for opposing or complaining about unlawful employment practices.
State and local jurisdictions also maintain fair employment protections. For example, in Washington, D.C., it is illegal to discriminate in any employment decision based on:
- Race
- Color
- Religion
- National Origin
- Sex
- Age
- Marital Status
- Personal Appearance
- Sexual Orientation
- Family Responsibilities
- Disability
- Matriculation
- Political Affiliation
The Equal Rights Center is committed to identifying, challenging and eliminating illegal discrimination in the workplace.
If you believe you are the victim of employment discrimination based on any of the categories mentioned above -- including sexual harassment -- contact the ERC for immediate assistance by sending an e-mail to info@equalrightscenter.org or by calling (202) 234-3062.
Please note that in most instances a charge of employment discrimination must be filed within 300 days of when the discriminatory act occurred. In some states a charge must be filed within 180 days.
The Equal Rights Center will perform fair employment surveys, tests and investigations, either under contract, a grant, or independently. The ERC conducts training, assists in the development of policies, practices and campaigns, conducts timely research in order to enhance compliance with fair employment law and eliminates illegal discrimination in the workplace.
The ERC urges employers to remain vigilant and aggressive about detecting and preventing discrimination that harms employees and prospective employees, damages morale and limits productivity.
If you are responsible for ensuring fair employment practices in your company, the ERC is prepared to work with you to review your company's fair employment policies and to confidentially survey your employees to ascertain the level of compliance achieved with legal requirements. The ERC will work with you to identify and implement best practices as needed.
